12A Registration

Section 12A of income tax act gives exemption to trusts, societies and non profit making organizations from paying income tax. Trust, Societies and other non profit making organization generally pay income tax on surplus of income over expenditure. If they take registration under section 12A of income tax, they do not have to pay income tax. It is thus important for all Trusts, NGOs and other Not-for-Profit organizations to know importance of provision of section 12A of Income Tax Act.

Application for 12A Registration

The aim of any taxation laws is to collect revenue for government, that ultimately use them for carrying out activities for welfare of the society. And because NGOs carry out activities of social importance, government has given exemption to these NGOs from paying income tax on surplus of income over expenditure. Charitable Trusts, Religious Trusts, Societies and Section 8 Companies claiming exemption under Section 11 and 12 of the Income Tax Act, can obtain 12A registration.

But Private or family trusts are not allowed such exemptions and cannot obtain 12A registration, only public trusts are allowed to take 12A Registration. To obtain 12A Registration, an application for registration of charitable or religious trust or institution under clause (aa) of sub-section (1) of section 12A of the Income-tax Act, 1961 can be made to the Commissioner of Income Tax along with the following documents:

Application in Form 10A.
Copy of Pan card and address proof of the All Trustees.
Copy or Registration Certificate with Charity Commissioner or copy of application.
Notarized Copy of the Trust Deed.
Copy of PAN Card of the Trust.
